Privacy Notice Pursuant to Personal Data Protection Act 2010 (“PDPA”)

This privacy notice ("Notice") is issued to all prospective and/or existing customers, participants, suppliers, vendors, independent contractors, and service providers of SRW Holding Sdn Bhd. [Company No. 202101000424 (1400722-X)] ("SRW Holding") pursuant to PDPA.

Definitions:

  • "Affiliates" refers to Agensi Pekerjaan SRW Sdn Bhd, SRW Holding Sdn Bhd, and any other enterprise, partnership, company, corporation, or organization that is a lawful licensee of the trade name "SRW Holding" and/or any other associated companies of SRW Holding, as may be updated from time to time, or their derivatives or modifications.
  • "Personal Data" includes all information related to commercial transactions that directly or indirectly identifies or can identify an individual from that information alone.
  • "Processing" involves activities such as collecting, recording, holding, storing data, organizing, adapting, altering data, using, referring to, retrieving, consulting data, disclosing, transferring data, or making data available to third parties, as well as aligning, combining, correcting, erasing, destroying data.

Collection of Your Personal Data

During your interactions with us, we may request and collect your Personal Data, which may include, but is not limited to:

  • Full name, nationality, identification number and/or passport number, ethnicity, preferred language, height, weight, date of birth, passwords provided to SRW Holding, profession, company name, job title, personal interests or preferences (such as language, product or content interests), communication and marketing preferences, contact details (such as contact number, email address, postal address), date of birth, age, gender, photographs or images, videos, bank account details, account details, details shared on social media platforms accessible to us, and any other information from which you may be identifiable.

Sources of Your Personal Data

We collect your Personal Data from a range of legitimate sources, including but not limited to:

  1. Information you provide through forms or our website (if any).
  2. Data entered into our "SRW Holding" app or any other application created by SRW Holding.
  3. Third parties, such as third-party service providers, social media platforms (e.g., Facebook, Instagram, YouTube, TikTok), business partners, credit reference agencies, and publicly available sources, including platforms where you have granted SRW Holding access.
  4. Personal Data provided at events sponsored or organized by us or our Affiliates.
  5. Participation in our questionnaires and surveys.
  6. Personal Data provided through business cards or other means to SRW Holding employees, clients, business associates, or our Affiliates.
  7. Voluntary distribution of your personal information.
  8. Lawyers, consultants, auditors, accountants, bankers, or other parties with whom you or we have dealings.
  9. such other written and/or verbal communications between you and any authorized agents SRW Holding and our Affiliates.

Purpose Purpose of Collecting Your Personal Information

The Personal Data we collect, process, and use serves the following purposes (collectively known as “Purpose”):

  1. To communicate with you.
  2. To provide products and/or services to you.
  3. To respond to your inquiries or complaints.
  4. To process your registration for our events.
  5. To process any relevant payments made to you, if applicable.
  6. To allow you access to our platform and application for job postings.
  7. To provide you with information and updates on current and future promotions, industry developments, other products, services, and promotions offered by SRW Holding and selected third parties, which may be of interest to you via SMS, phone calls, email, fax, mail, social media, and other communication channels.
  8. To send you seasonal greetings from time to time.
  9. To send you invitations to future memberships, events, and promotions (if any).
  10. To monitor, review, and improve SRW Holding’s future memberships, events, promotions, products, and/or services.
  11. To process and analyze your Personal Data either individually or collectively with others.
  12. To conduct market research, surveys, client profiling activities, planning, and statistical analysis within SRW Holding and its Affiliates in relation to current and future industry developments, other products, and/or services.
  13. To share your Personal Data with auditors for internal audit purposes.
  14. To maintain and improve customer relationships.
  15. To maintain and update internal record-keeping.
  16. For internal administrative purposes.
  17. For detecting, investigating, and preventing fraudulent, prohibited, or illegal activities.
  18. To enable SRW Holding and its Affiliates to perform their obligations.
  19. To meet any applicable legal or regulatory requirements and make disclosures as required by law, regulation, direction, court order, by-law, guideline, circular, or code applicable to SRW Holding.
  20. To enforce or defend SRW Holding's and your rights under applicable laws, legislation, and regulations.
  21. For other purposes required to operate and maintain SRW Holding’s and its Affiliates’ business.

By interacting with us, you agree and consent to our use and processing of your Personal Data in the manner identified in this Notice.

Disclosure to Third Parties

We may disclose your Personal Data to the following third parties:

  1. Affiliates of SRW Holding and their respective employees.
  2. Your immediate family members and/or emergency contact persons as notified to SRW Holding and/or its Affiliates from time to time.
  3. SRW Holding's business partners and Affiliates that provide related products and/or services in connection with our business.
  4. SRW Holding's clients and relevant agencies related to the job for which you have applied via the SRW Holding application or platform.
  5. Any person under a duty of confidentiality who has undertaken to keep your Personal Data confidential and whom SRW Holding has engaged to fulfill its obligations to you.
  6. Any party in relation to legal proceedings or prospective legal proceedings.
  7. Our auditors, consultants, accountants, or other financial or professional advisers.
  8. Data centers and/or servers located within or outside Malaysia for data storage purposes.
  9. Payment channels, including but not limited to financial institutions, for the purpose of assessing, verifying, effecting, and facilitating payment of any amount due to SRW Holding or its Affiliates in connection with your service provided to SRW Holding, its Affiliates, or SRW Holding’s ultimate clients or relevant agencies.
  10. Government agencies, statutory authorities, industry regulators, and other similar authorities.
  11. Our contractors or third-party service or product providers, as necessary or appropriate.
  12. Any persons, authorities, or regulators to whom SRW Holding is permitted or required to disclose, in accordance with its contractual obligations with third parties or under applicable laws.
  13. The general public when you become a winner in a contest by publishing your name, photographs, and other Personal Data without compensation for advertising and publicity purposes.

Consequences of Refusal or Failure to Provide Personal Data

The supply of your Personal Data to us is voluntary. However, in the event you choose not to provide your consent or subsequently withdraw your consent to the processing of the Personal Data by us, we will be unable to fulfill our obligations to you in relation to the Purpose.

Please also take note that your failure to provide us your Personal Data may result in amongst others, the following:

  • Our inability to communicate with you on the products or provide the services you require.
  • Our inability to effectively manage and update your records with us.
  • Our inability to provide you with updates about our latest launches and/or promotions and/or services and/or products available to you.

Your Rights of Access to, Correction, and Limiting the Processing of Your Personal Data

You may at any time hereafter request access to your Personal Data and have a copy of it by submitting such a request in writing. If you are of the view that your Personal Data is inaccurate, misleading, incomplete, or out-of-date, you may also make a request in writing for correction.

If you do not wish to receive notifications and marketing materials from us or would like us to cease processing your Personal Data in a specified manner, you are entitled to submit a written request for such restriction of the processing of your Personal Data. We will take reasonable endeavors to comply with your request. We may, however, refuse to comply with the requests under circumstances as permitted by law.

Security of Personal Data

We take reasonable steps to ensure that your Personal Data is protected from unauthorized access and misuse. We also require all our data processors to take reasonable security measures in the processing of your Personal Data.

Data Integrity

You are advised to initiate a review of your Personal Data. Upon receipt of your written requests for correction of your Personal Data, we will take reasonable steps to rectify the Personal Data which is inaccurate, incomplete, and not up-to-date unless we consider there are justifications for refusing to comply with your requests.

Changes to the Personal Data Protection Notice

We reserve the right to modify, update, or amend the terms of this Notice at any time by placing the updated Notice online through our website and/or the SRW Holding application. By continuing to deal with us or by engaging us following the modifications, updates, or amendments to this Notice, it is deemed that you have accepted such modifications, updates, or amendments unless you have expressly stated otherwise in writing to us.

Language

This Notice is issued in both the English and Malay languages. In the event of any inconsistency between these two versions, the English version shall prevail.

Miscellaneous

You will be deemed to have consented to allow us to collect, record, hold, store, process, and deal with your Personal Data until and unless we receive written notice to the contrary from you.
